1. Acceptance of Terms

By accessing or using the Color Your Life website and services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and Color Your Life LLC, a Rhode Island limited liability company.

2. Eligibility

Our Services are intended for use by adults aged 18 or older. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. Accounts must be created and managed by a parent or legal guardian. We do not knowingly permit children under 13 to create accounts or use our Services independently.

3. Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and notify us immediately of any unauthorized access.
• Accept responsibility for all activities that occur under your account.

4. Orders and Payments

You may purchase personalized coloring books through our platform using the following methods:

• Subscription: A recurring monthly subscription that includes one free personalized coloring book per month while your subscription is active.
• One-Time Credit: A single book purchase made through Stripe Checkout.

All payments are processed securely through Stripe. By placing an order, you authorize us to charge your selected payment method. Prices are displayed in U.S. dollars and are subject to change. You are responsible for any applicable taxes and shipping fees.

5. Subscription Terms

Subscriptions renew automatically on a monthly basis unless canceled. You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of the current billing period. You will not receive a partial refund for the remainder of the billing period. Subscription eligibility for a free monthly book is calculated based on your subscription status and last book generation date.

6. Photo Uploads and User Content

You retain ownership of any photos or images you upload to our platform (“User Content”). By uploading User Content, you grant Color Your Life a limited, non-exclusive license to use those images solely for the purpose of generating your personalized coloring book. You represent and warrant that:

• You own or have the necessary rights to the photos you upload.
• Your photos do not infringe on any third-party intellectual property, privacy, or publicity rights.
• Your photos do not contain unlawful, defamatory, obscene, or otherwise objectionable content.

We reserve the right to refuse processing of any image that violates these terms.

7. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Color Your Life or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, revocable license to access and use the website for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

The personalized coloring books you purchase are for your personal use and the use of your immediate family. You may not resell, reproduce, or commercially exploit the generated books without our prior written consent.

8. Refunds and Cancellations

Because our products are custom-made using your uploaded photos, all sales are final once an order enters processing. If your order has not yet entered processing, you may request a cancellation by contacting us at coloryourlife1@proton.me. We will review cancellation requests on a case-by-case basis. Subscription cancellations follow the terms described in Section 5.

9. Limitation of Liability

To the fullest extent permitted by law, Color Your Life shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

We do not guarantee that our Services will be uninterrupted, error-free, or completely secure. You use our Services at your own risk.

10. Disclaimers

Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no warranty that the generated coloring pages will meet your specific expectations, as results may vary depending on photo quality, composition, and other factors.

11. Indemnification

You agree to indemnify, defend, and hold harmless Color Your Life and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Rhode Island, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the effective date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

14. Termination

We reserve the right to suspend or terminate your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, all licenses granted to you under these Terms will immediately cease.
